The Provision of Entering into a Marriage Contract through the Internet حكم إبرام عقد النكاح بالكتابة عبر الانترنت

Abstract

جاءت هذه الدراسة لمعرفة حكم صورة من صور النكاح المستحدث، ألا وهي عقد النكاح بالكتابة عبر الانترنت، إذ أن هذا الأخير يبرم في مجلس عقد حكمي يغيب فيه الزوجين والشهود عن مجلس العقد، وهذا ما دفع فقهاء الشريعة الاسلامية إلى الاختلاف في حكمه بين مانع ومجيز، لنرجح القول بالجواز وفق شروط وضوابط. This research study seeks to know the provision of a type of modern marriage contracts which is the one conducted via the internet. This marriage contract is held in a legal council where the couple being married and witnesses are absent. This case has pushed Islamic law (Sharia) scholars to differ among themselves concluding two provisions of this kind of marriage. Some scholars permit it whereas others do not. We shall outweigh the first provision with some conditions and controls.
