التحقيق في منهج ترك أخبارغير الحجازيين ( نسبة، واسبابا، و آثارا )

Abstract

تبحث هذه الدراسة، منهجًا مِنَ المناهج التي سَلَكَها كثير مِن فُقهاء الحِجاز في قَبول الرِّواية والاحتجاج بها؛ وهو تركُ أخبار غير الحِجازيِّين، خاصَّةً الأخبار العِراقية. فجاءت هذه الدِّراسةُ لتُبيِّن هذا المنهجَ، وتُحقِّق في نسبته إلى بعض المذاهب، والفقهاء. كما اهتمَّ البحثُ بدراسة الأسباب التي حَملتهم على سُلوك هذا المنهج، والأخذ فيه. وعُنِيَ كذلك بدراسة الآثار التي نَتَجتْ عنه، في التفقُّه لدى بعض المذاهب، ومدى أثره في وُقوع الخلاف الفقهي واستِمراره بين أتباع المذاهب الفقهية، وأثر ذلك في الصِّلات العلمية بين عُلماء الأمصار في الطبقات الأُوَل مِن عُصور الفقه الإسلامي. The approach of neglecting the narrations of non Hijazi Jurists (Authenticity, reasons and effects) abstract This study examines one of the approaches that Hijazi scholars have made use of in the process of accepting the narrations. This approach is commonly referred to as “neglecting the narrations of non Hijazi, especially the Iraqi narrations”. This study intends to illustrate this approach in a detailed manner, as well as to investigate its use by some schools and jurists. In addition, this study sheds light on the reasons behind this approach. Furthermore, this study examines the effects resulted in adopting such approach within some juristic schools, its influence on jurisprudential differences, and its impact on the scientific connections between the scholars of the first era of the Islamic jurisprudence.
