الحوافز الجبائية للإستثمار في الجزائر

Abstract

عرفت مرحلة التسعينات جملة من النصوص التشريعية المنظمة للاستثمارات خارج قطاع المحروقات قصد تشجيع هذا الأخير وفك العزلة عنه، ومسايرة التوجهات الجديدة التي سلكها الاقتصاد الوطني وهو الانتقال من النظام الاقتصادي المخطط إلى النظام الاقتصادي الحر، وتحضيرا للانضمام المرتقب للمنظمة العالمية للتجارة والدخول في منطقة التبادل الحر مع الاتحاد الأوروبي في إطار اتفاقيات الشراكة، فكل هذه العوامل أوجبت على الدولة إعادة النظر في أطرها القانونية، وتجسد ذلك بالفعل من خلال الإجراءات التي تضمنها قانون النقد والقرض، وكذا المرسوم التشريعي رقم 93/12 المؤرخ في 05/10/1993 والمتعلق بترقية الاستثمارات. سنحاول في هذا البحث التعرض لأهم ما جاءت به قوانين الاستثمار مند الاستقلال وحتى هذه الفترة بخصوص الضمانات والتسهيلات والمزايا الممنوحة لجلب وتشجيع الاستثمارات وخلق فرص الشغل، وكذلك التعرض للآليات الإجرائية لتجسيد هذه الحوافز في ارض الواقع عن طريق الوكالة الوطنية لتطوير الاستثمار ANDI. abstract:‎ Given the nineties directed a number of legislative Organization for investment outside the oil sector in order to keep pace with new trends that have continued the national economy, a transition from a planned economy system a free economic system, in preparation for joining the World Trade Organization and to engage in the commercial area with the European Union in the framework of partnership agreements, each of these factors required the State to revise legal frameworks and already embody through the procedures in the Code of Money and Loan and the 10.05.1993 Decree No. 93/12 dated and upgrading investments.
