السلطة التقديرية للإدارة

Abstract

التزامات الإدارة متعددة ومتنوعة ولا تقبل بطبيعتها التحديد وذلك لعدة اعتبارات تكمن في أن الأعمال الإدارية في حد ذاتها ليست امتيازا مخولا للجهة الإدارية بل هي عبارة عن التزامات ومسؤوليات تؤدي إلى مساءلة الإدارة تأديبيا عن الأخطاء والمخالفات التي قد تقع منها أثناء تأدية هذه الأعمـال الإدارية .وذلك بغض النظر عن الأسلوب الذي انتهجته الإدارة (سلطة تقديرية أو سلطة مقيدة). وتجدر الإشارة إلى أن سلطة الإدارة التقديرية مسألة ضرورية لا بد من التسليم بما إذ هي ترتبط بطبيعة الوظيفة الإدارية، ويفرضها الصالح العام، ويؤكدها عجز المشرع عن تنظيم جزئيات وتفصيلات الأعمال الإدارية، ولكن هذه السلطة ليست مطلقة بل أنها مقيدة بما استهدفه التشريع من صالح عام. Abstract : The obligations of the administration are several and various, due to their nature, they don’t accept the determination for many reasons that the administrative works are not a privilege provided to the administration, but they are obligations and responsibilities which lead to the disciplinary process of the administration concerning the errors and infractions that can be happened during the achievement of these administrative works, and this, regardless to the style which is adopted by the administration (appreciative authority or restrictive authority). It should be noted that the appreciative authority of the administration is an obligatory matter that must be recognized because it is related to the nature of the administrative function, and imposed by the public interest, it is also confirmed by the deficit of the legislator to organize the details of the administrative works, but this authority is not absolute, it is restrictive through which is aimed by the legislator concerning the public interest
