الحماية الجنائية للتصديق والتوقيع الإلكتروني

Abstract

يعتبر التوقيع شرطا أساسيا في توثيق المستندات سواء كانت تقليدية أو إلكترونيا محلية أو دولية ونسبتها إلى مصدرها، فالتصديق أو التوقيع الالكتروني ذو فوائد جمة، سواء على جانب الخدمات العامة ،و له بالغ الأثر على التجارة الالكترونية. عمليا التصديق الالكتروني هو طريقة اتصال مشفرة رقميا تعمل على توثيق المعاملات عبر الانترنت. تفاعل عوامل المتعامل ومتعامل معه وموفر خدمات التصديق ومستعمل الانترنت ينشأ أفعالا مجرمة. وهو موضوع هذه الدراسة: ماهية التوقيع الالكتروني من منظور عربي وغربي، وكذلك أفعال التعدي على التوقيع الالكتروني من منظور النظامين اللاتيني والانجلوسكسوني والعقوبات المرصودة للمخالفين في كل نظام ودراسة المسألة من منظور وطني جزائري.
