البُـعـد المقــاصدي لأحكــام النِّظام الأُسَـــري عند سمـاحة الشَّيخ محمَّد الطَّاهر بن عاشور من خـــــلال تفسيــره " التَّحــريـــر والتَّـنـــويـــــــر

Abstract

الشَّيخ محمَّد الطَّاهر بن عاشور التونسي من أبرز علماء العصر الحديث، الذين خدموا مقاصد الشَّريعة الإسلامية، واهتموا بأسرارها وحِكمها، فألَّف كتابه القيِّم:" مقاصد الشَّريعة الإسلامية "، إلاَّ أنَّ هذه النَّزعة المقاصدية لازمته في جميع مؤلَّفاته، خاصَّة في كتابه:" التَّحرير والتَّنوير في التَّفسير "، والذي اخترنا منه بعض الأسرار الخاصَّة بأحكام فقه الأسرة، التي لم يتعرَّض لذكرها في كتاب المقاصد، أكَّد فيها صلاحية الشَّريعة الإسلامية لكلِّ زمان ومكان. الملخص باللُّغة الانجليزية: The Tunisian Shaikh Muhammad Tahar Ibn Ashur was one of the most brilliant modern scholars who served much the Purposes of the Islamic Sharia (Maqasid) and were interested in its secrets and wisdom. He wrote in this field his valuable book entitled « Maqasid Sharia Islamiya » (The Purposes of the Islamic Sharia), but this tendency accompanied him all along his writings and books mainly the Quranic exegeis « Tahrir and Tanwir fi Tafsir »(The Verification and Enlightenment) from which we have selected some secrets of the family system that showed some purposes and wisdoms which were not mentioned in his book « Maqasid ».
