الطلاق بلا سبب وأثره في التعويض

Abstract

شرع الزواج في الشريعة ليكون عقدا أبديا يبقى ما بقي الزوجان على قيد الحياة. ولذلك لا ينعقد صحيحا على وجه التأقيت. ولكن هذا الزواج قد يعرض له ما يعكر صفوه كالتباين، والطباع، وعدم التوافق، والانسجام بين الزوجين مما يجعل الحياة الزوجية جحيما لا تطاق, فشرع الإسلام الطلاق لأنه لم يرض أن يجعل من الزواج سجنا لا يخرج منه الزوجان إلا بالموت أو بقتل أحدهما للآخر. والسؤال الذي يطرح هل الطلاق حق مطلق يمارسه الزوج متى شاء وكيفما شاء أم هو مقيد بعدم الإضرار والتعسف. وهذا ما سنحاول الإجابة عنه من خلال هذا البحث الذي قسمته إلى مطلبين المطلب الأول: الطلاق التعسفي المطلب الثاني: الطلاق في مرض الموت Abstract Marriage was prescribed in Islamic legislation as a lifelong contact between wife and husband. Unfortunately, this marriage may be subject to controversies; such as differences in temper, character and incoherence between wife and husband the fact that makes conjugal life unbearable. For that only, Islam legitimizes divorce since it is not a prison that none of the wife and husband would get out unless dead, or by murdering one another. The question that one might pose is divorce an absolute right the husband enjoys without restrictions; that he may resort to whenever and in whatever way wanted; or it is restricted not to be abusive, coercive and harmful to the other side. The present research paper tries to answer this question. Therefore, it is divided into two topics.
