النظام القانوني للإيجار العقار الوقفي الفلاحي المسترجع من الدولة

Abstract

يُشكل العقَار الوقفي الفلاحي حيِّزا هاما من مجموع الأملاك المُشكلة للمنظومة الوقفية في الجزائر منذ نشـأتها ، هذه الأملاك التي وقع جزءٌ هامٌ منها تحت طائلة التأميم بموجب الأمر 71 / 73 المنظِم لمشروع الثورة الزراعية ، مما استوجب قيام نظام قانوني تصحيحيٍ يقوم أولاً على استرجاع تلك الأملاك الوقفية المؤممة ثم التنصيص ثانياً على جملة من الآليات والشروط التي تسري على عقد الإيجار الواقع على هذا النوع من العقار الوقفي الفلاحي ، وهو ما تحقق من خلال المرسوم التنفيذي 14 / 70 المحدد لشروط و كيفيات إيجار الأراضي الوقفية المخصصة للفلاحة ، حيث جاءت هذه الدّراسة للوقوف ليس على كيفيات وشروط إيجار العقار الوقفي الفلاحي عموما إنما على ما استُرِجع من الدولة بعد تأميمه فقط . The property of agricultural endowment constitutes an important part of the total property of the waqf system in Algeria since its inception. These properties, which were part of a major part under nationalization under Order 71/73 regulating agricultural revolution, necessitated a corrective legal system that first retrieves those nationalized property The second section is based on a number of mechanisms and conditions that apply to the lease contract for this kind of agricultural endowment property, which was achieved through decree No. 14/70, which is specific to the conditions and modalities of leasing the waqf lands allocated for agriculture, Where this study came to stand not on the modalities and conditions for the rental of agricultural endowment property in general but on what was recovered from the state after nationalization only .
