Abstract

حافظ القضاء الشرعي على مكانته في الدولة الإسلامية منذ عهود بعيدة فكان القاضي يجمع بين السلطة الدينية والسيادية، لذلك فهو يعتبر من المناصب الهامة. وبدخول الفرنسيين إلى الجزائر تقلص دوره إلى أن أصبح شبه منعدم لكن تمكنت جبهة التحرير الوطني من استرجاع مكانته وقيمته السلطوية والاجتماعية وفق قيم ومبادئ الدين. ومن هنا جاء موضوع هذه المداخلة القيم الإسلامية في القضاء أثناء الثورة التحريرية، والتي نتساءل فيها عن جهود جبهة التحرير في استرجاع أهم مؤسساته السيادية؟ ومنابعه التشريعية؟
