نداء مكتب جمعية العلماء المسلمين الجزائريين في القاهرة إلى الشعب الجزائري

Abstract

قراءة النصوص التاريخية معوانٌ على حفظ ذاكرة الأمة الجمعيَّةِ، وبخاصة النصوصُ التي تشكِّلُ منعرجا في فهمِ الأحداث، ومن ذلك: نداء مكتب جمعية العلماء المسلمين الجزائريين في القاهرة إلى الشعب الجزائري، بتاريخ: 15 نوفمبر 1954 م، وهو بعنوان: "نداء إلى الشعب الجزائري المجاهد: نعيذكم بالله أن تتراجعوا ...". والبيان ذو قيمة تاريخية وفقهية من ناحية تاريخ صدوره؛ فقد كتب بعد نصف شهر من اندلاع الثورة، ومن ناحية هيئته العلمية، وهو مكتب الجمعية بالقاهرة برئاسة الإمام الإبراهيمي وبمعيَّة الشيخ الورثيلاني، وهم فقهاء في الشريعة الإسلامية. وبعد فحص البيان واستبطانه؛ انتهت المداخلة إلى نتائج، هذه أهمها: 1. البيان مؤيِّدٌ لشرعية الثورة بلا امتراء، وقد ألبسها سربال الجهاد المشروع. 2. احتكم البيان إلى المرجعية الفقهية الشرعية، وإن نحى منحى الخطاب الإعلامي. 3. قطعَ البيانُ في الحكم الفقهي لنصرة الثورة، وتميَّز بالصرامَةِ في إطلاق أحكام الردة على من ينصر المستدمر، ويرضى باحتلاله. 4. عوَّلَ البيان على العاطفة الدينية عند الشعب الجزائري، ووظَّفها في التحريض على الثورة. 5. لم يعتبر البيان التفاوت في القوة بين مجاهدي الثورة والمحتل الغاشم. 6. عدَّ البيان الثورةَ ضرورةً لا خيارَ في خوضها، ولا اعتبار لأيِّ شرطٍ في نُصرتها. 7. نسَفَ البيان شبهة التعاون مع المحتلِّ مع دعوى حسن النيَّةِ، ورفض الاستناد إلى الضرورة إلا في شؤون الأفراد لا الأمة والجماعات. 8. حرص البيانُ على الوحدة الوطنية في ظل مبادئ الإسلام، وهو ما يتماهى مع بيان أول نوفمبر 1954م. هذا، وقد انتهت المداخلة إلى إشكالٍ جديرٍ بالبحث مع التجرُّد والموضوعية؛ وهو: لماذا يحصل اللغط أو الغلط في موقف الجمعية مع وجود هذا البيان وأشكاله؟، ومهما كان الجواب؛ فإنَّ الإشكال متعلقٌ بسؤال السبق، ومن أدرك ركعة مع الإمام فقد أدرك الصلاة !. Reading historical texts helps preserve the nation’s memory, including: An appeal from the office of the Association of Algerian Muslim Scholars in Cairo to the Algerian people, dated: November 15, 1954 AD, entitled: “An Appeal to the Mujahid Algerian People: We seek refuge with God from you not to retreat.... The statement has historical and jurisprudential value in terms of the history of writing. It was written half a month after the revolution, and by the Scientific Committee, which is the association’s office in Cairo headed by Imam Al-Ibrahimi and Sheikh Al-Warthilani, who are jurists in Islamic law. After studying the statement; We reached results, the most important of which are: 1. The statement completely approved of the revolution, and described it as jihad. 2. The statement was based on Islamic jurisprudence, and was written by scholars in the form of an informational text. 3. The statement confirmed the jurisprudential ruling in support of the revolution, and was distinguished by its severity in issuing rulings of blasphemy on the agents of colonialism. 4. The statement used the religious sentiment of the Algerian people to incite revolution. 5. The statement did not stipulate parity in force between the mujahideen and the brutal occupier. 6. The statement believes that revolution is necessary for liberation. 7. The statement nullified cooperation with the occupier while claiming good faith, and rejected the claim of necessity except in cases of individuals only. 8. The statement emphasized national unity within the framework of the principles of Islam, which is consistent with the statement of November 1, 1954 AD. The intervention pointed out a problem in the research; Which is: Why is there so much talk about the position of the Association of Scholars despite the existence of this statement and others like it? And whatever the answer is; The question relates to precedence, and whoever prays one rak’ah with the imam has completed the prayer!
