Abstract

تعد حوادث الامتناع عن مساعدة الغير بصفة عامة، وعن تقديم المساعدة الطبية لمن يحتاجها مشكلة من أهم المشاكل التي تمس حياة الإنسان، وتدل دلالة واضحة على وجود خلل في المجتمع منشؤه البعد عن تعاليم الدين الإسلامي الحنيف، واعتقاد البعض أنه لا يجب عليه تقديم المساعدة، لغيره إلا إذا كان عليه التزام قانوني أو تعاقدي، وهذا الاعتقاد ناشئ من أن قانون العقوبات لم يتضمن نصا يقضي بإلزام الطبيب بعلاج المريض أو نصا يقضي بالإلزام بالمساعدة بصفة عامة. وإزاء هذا القصور التشريعي كان لا بد من بحث هذا الموضوع. And about this legislative deficiency, this topic had to be discussed.
