حفظ الأمن وعلاقته بالعدالة والمسؤولية الجنائية والمدنية في الشريعة الإسلامية

Abstract

يشكل موضوع حفظ الأمن أهمية بالغة في حياة الشعوب والأمم؛ نظرا لما يترتب على تحقيقه من آثار إيجابية في جميع المجالات : السياسية، والاقتصادية، والاجتماعية، ونظرا لهذه الأهمية، فقد تناولت في هذا البحث الحديث عن حفظ الأمن وعلاقته بالعدالة والمسؤولية الجنائية والمدنية في الشريعة الإسلامية . ويشكل الحديث عن حفظ الأمن عنصرا مهما في هذا البحث؛ وذلك من حيث بيان مفهومه، وما ورد بخصوصه في النصوص الشرعية، وعلاقة حفظ الأمن بطبيعة السلوك البشري في علاقته مع الله عز وجل . وكل هذه المباحث يتضمنها المحور الأول من هذا البحث، وأما المحور الثاني فيتناول تحليل العلاقة بين حفظ الأمن والعدالة والمسؤولية الجنائية والمدنية في الشريعة الإسلامية . ومعالجة هذين المحورين ستتم باستخدام المنهجين : الاستقرائي والتحليلي، والاعتماد على المصادر والمراجع التي تتضمن مادة علمية ذات صلة بموضوع البحث . Abstract of the Research: The subject ofmaintaining security is of a paramount importance in the life of peoples and nations; due to the consequentachieved positive impacts in all fields: political, economic, social, and regarding this importance, In this research I have dealtwith the talk about the maintenance of security and itsrelationship with the justice, and the criminal and civil responsibility in the Islamic Legislation. The talk about maintaining security formed an essential element in this research; in terms of showing its concept, and concerning whatismentioned about it in the religioustexts, and the relationship of maintaining the security with the nature of human behavior in his relationship with Almighty Allah. And all of thesesections have been included in the first axis of thisresearch; while the second axis treated the analysis of the relationshipbetweenthe justice, and the criminal and civil responsibility in the Islamic legislation Then the treatment of these two axes will be done by using two methods: inductive and analytical, and relying on sources and references that include scientific substance relevant to the subject of the research.
