موت الدماغ في ضوء ضوابط الفتوى في النوازل المعاصرة وفق نظرة مقاصدية

Abstract

لقد أجاب فقهاء العصر عن نازلة موت الدماغ، وعقدت من أجل ذلك ندوات علمية عديدة، خلصت إلى رأيين أساسيين، فما مدى تطابق ذلك والمعايير الشرعية للفتوى في النوازل المعاصرة شكلا ومضمونا، فهذه الدراسة عبارة عن تسليط للضوء على تلك الآراء الفقهية، للنظر في مدى موافقتها لضوابط الفتوى الشرعية المتعلقة بالمستجدات المعاصرة، وفق نظرة مقاصدية للموضوع. ABSTRACT: The jurists of the era have answered the issue of brain death, and many scientific symposiums were held for this, which concluded with two basic opinions. What is the extent to which this corresponds with the legal standards for the fatwa in contemporary issues in form and content? This study is a shedding light on those jurisprudential opinions, to consider the extent to which it agrees with the legal fatwa controls related to contemporary developments, according to the maqasid view of the subject.
