النظام ئ القانوني للهيئة الوطتية للوقاية من الفساد ومكافحته في ظل القانون 01/06

Abstract

نتيجة للانتشار الرهيب لظاهرة الفساد في الجزائر، خاصة ما نشهده اليوم، حيث أصبحت هذه الظاهرة تجوب مختلف الميادين، فالواقع أن المشرع الجزائري قد منح أهمية كبيرة لمكافحة الفساد بكل أنواعه في سياسته التشريعية، حيث رصد مجموعة من الأجهزة المتخصصة في مكافحة الفساد، ومن بين هذه الأجهزة الهيئة الوطنية للوقاية من الفساد ومكافحته التي استحدثها المشرع الجزائري من خلال القانون 06/01 والمتعلق بالوقاية من الفساد ومكافحته في الباب الثالث منه، حيث تسعى هذه الأخيرة لتصدي لكل أنواع الفساد بمختلف أشكاله، وذلك باستعمال طرق وقائية وأخرى رقابية، ومن خلال هذا المقال نسعى لتسليط الضوء على النظام القانوني للهيئة، باعتبارها هيئة وطنية مستقلة، ذات تشكيلة خاصة، لها صلاحيات متعددة تختلف بين الوقائي التحسيسي والإداري الرقابي. الكلمات المفتاحية: النظام القانوني -الهيئة الوطنية للوقاية من الفساد ومكافحته- القانون 06/01 Abstract ; As a result of the terrible spread of the phenomenon of corruption in Algria, especially what we are witnessing today , where this phenomen is roemingthe varios fields , the fact that the Algerian legislator has given great importance to combating corruption in all its forms in the legislative policy, where the monitoring of a number of specialized agencies in the fight against corruption, the National Commission for the Prevention and Combating of Corruption, established by the Algerian legislator through Law 06/01 on the Prevention and Control of Corruption in chapter 03, which seeks to address all forms of corruption in various forms, using preventive and control methods, and through which we will highlight the legal seystem of the commission as an independentnational body A special combination has multiple powers that vary between prevenyive and management awarreness..
