Abstract

لقد اهتم الغرب بموضوع الوقف اهتمامًا علميًا لافتًا، ولم يكن اهتمامه مقتصرا على تناول هذا الموضوع من زاوية علمية محددة، بل كان متنوعًا وشاملاً لميادين علمية مختلفة، كالتاريخ وعلم الاجتماع، وحتى الميدان القانوني والتشريعي الذي يرتكز في أساسه على ما قرّره الفقه الإسلامي. ويُعد في هذا المقام (إرنيست مورسييه) أحد أبرز المشتغلين بالبحث الفقهي والقانوني للأحكام التشريعية المنظمة للوقف، كمسألة الجذور التاريخية والتأسيسية للوقف، وعلاقة هذا الأخير بالقواعد المنظمة للميراث في التشريع الإسلامي، بالإضافة إلى إشكالية الطبيعة القانونية للملكية الوقفية وأثرها على العمل القضائي في البلدان المستعمرة، وغيرها من المسائل والقضايا التشريعية الأخرى التي كانت محل تحليلٍ ونقدٍ علميٍ من قِبل (مورسييه). English summary The West has paid attention to the issue of the wakf with remarkable scientific interest, and its interest was not limited to dealing with this topic from a specific scientific angle, but rather it was diverse and encompassing different scientific fields, such as history, sociology, and even the legal and legislative field that is based on what was decided by Islamic jurisprudence. In this respect, (Ernest Mercier) is considered one of the most prominent practitioners in the jurisprudential and legal research of the legislative provisions regulating the wakf, such as the issue of the historical and foundational roots of the wakf, and the relationship of the latter with the rules governing inheritance in Islamic legislation, in addition to the problem of the legal nature of wakf property and its impact on judicial work in colonial countries And other issues and other legislative issues that were the subject of scientific analysis and criticism by (Mercier).
