تحديد مفهوم الغنيّ بين الموسّعين والمضيّقين, وأثر ذلك على الزّكاة إعْطاءً ومَنعًا

Abstract

يدور هذا البحث على مسألة تحديد معنى الغنيّ الذي يمنع الزّكاة، وهل أنّ كلّ الأغنياء يمنعون الزّكاة بناء على ظواهر بعض النّصوص، أم هناك مقدار من المال من بلغه، أو حصّله يمنع من أخذ الزّكاة حتّى ولو لم يكن من الذين يخرجون الزّكاة، أم أنّ الأمر متروك لاجتهادات العلماء وأعراف النّاس التي تضبط هذا المعنى الذي يراد تحديده للغني، وهدف البحث هو إبراز المعنى الأدقّ للغني ممّا يضمن حقّ الفقير، ويضمن حتّى حقّ الغنيّ في بعض الأحيان، وبعد استقراء أقوال العلماء وتحليلها ودراستها وفق المنهج التّحليلي توصّلت إلى نتائج مهمّة مفادها أنّ اختلاف النّظرات السّابقة، وتضارب الآراء في المسألة جعل العلماء ينقسمون إلى فريقين: فريق وسّع في معنى الغنيّ الذي يمنع الزّكاة، وغلّب حقّ المستحقّين للزّكاة، وفريق ضيّق معنى الغنيّ الذي يمنع الزّكاة وراعى حال الغني نفسه. Abstract: This research revolves around the issue of defining the meaning of the rich who forbids zakat, and whether all rich people withhold zakat based on the phenomena of some texts, or is there an amount of money who reaches it, or earned it prevents from taking zakat even if he is not from those who pay zakat, or is the matter It is left to the jurisprudence of scholars and the customs of the people that control this meaning, which is intended to be defined for the rich. The aim of the research is to highlight the most accurate meaning of the rich, which guarantees the right of the poor, and even guarantees the right of the rich in some cases. He expanded on the meaning of the rich who withholds zakat, and gave precedence to the right of those who are entitled to zakat, and narrowed the group to the meaning of the rich who withholds zakat and took care of the condition of the rich himself.
