البدائل الشرعية للغرامات التأخيرية في عقود المداينات بالمصارف الإسلامية

Abstract

تسعى هذه الورقة البحثيّة للكشف عن البدائل الشّرعيّة للفوائد التّأخيريّة الّتي تفرضها بعض المصارف الإسلاميّة على عملائها عند تأخرهم عن تسديد ديونهم، لكون هذه الغرامات غير جائزة شرعا؛ فهي من ربا الجاهلية المحرّم بالنّصوص القطعية. وقد سلكت هذه الدّراسة في معالجة الموضوع طريقا ثلاثي المسلك، يسعى الأول لتبيين المسوّغات الشّرعيّة للقول ببطلان الغرامات التّأخيريّة، ويكشف الثّاني والثالث عن البدائل الشّرعيّة الوقائية والعلاجية للغرامات التأخيرية. Abstract: This research attempts to reveal the legitimate alternatives to the delay benefits imposed by some Islamic banks on their customers when they are late in paying their debts, because these fines are not religiously permissible; It is from the usury of pre-Islamic epoch that is forbidden by definitive texts. In dealing with the issue; the present research took a three-way path. The first seeks to clarify the legitimate justifications for the invalidity of delay fines, the second and third reveal legitimate preventive and curative alternatives to delay fines.
