نحو محتكمات معاصرة للانتخاب السياسي : رؤية شرعية

Abstract

يتساءل كثير من المسلمين عن المعيار الذي يجيب عن تساؤلاتهم ويساعدهم في اختيار الحاكم الكفء والنائب المقتدر على رعاية مصالحهم بما يتوافق مع شريعة ربهم ويحفظ لهم مصالح دنياهم. لذا سعى هذا البحث للإجابة عن هذا التساؤل بهدف تحديد محتكمات يمكن تطبيقها في الحياة المعاصرة من أجل منح الثقة للحاكم أو أعضاء المجالس المنتخبة. سلك البحث منهجا استقرائيا تحليليا نقديا، وجاء البحث في مقدمة وخاتمة وثلاثة محاور؛ الأول في شروط كفاءة النظام السياسي، والثاني في شروط كفاءة البرنامج السياسي، والثالث في شروط كفاءة الأشخاص المنتخبين. وخلص الباحث إلى أن شرْطَيْ كفاءة النظام السياسي هما تحقيق مبدأي السيادة للشرع والسلطة للأمة، وأن شرط البرنامج السياسي توافقه مع المبادئ الإسلامية ومقاصد الشريعة، وأن شروط الأشخاص عديدة أهمها الإسلام والعدالة والسن القانوني والكفاءة الجسمية والخبرة وكفاءة الأداء. Many Muslims wonder about the standard that answers their questions and helps them choose a competent ruler and representative who is able to take care of their interests in accordance with Islam and preserve the interests of their lives. Therefore, this research seeks to answer this question in order to identify references that can be applied in contemporary life in order to give political legitimacy to the ruler or elected institutions and representative people. The research took an inductive, analytical and critical method. The research included an introduction, a conclusion, and three chapters. The first is the efficiency of the political system, the second is the efficiency of the political program, and the third is the efficiency of the elected people. As a result of the research, it is required for efficiency of political system respecting of Sharia sovereignty and authority of nation, and for efficiency of political program the compatibility with Islamic principles and purposes of Sharia, and for efficiency of people: Islam, justice, legal age, physical competence, experience and performance efficiency.
