العقارات غير المطالب بها(حساب المجهول سابقا) كآلية من آليات تطهير الملكية العقارية في الجزائر

Abstract

واجهت عملية مسح الأراضي صعوبات وعراقيل تتعلق أساسا بغياب أصحاب الحقوق أثناء التحقيق، وكذا صعوبة تحديد الملاك أو الحائزين الفعليين لبعض العقارات الخاضعة لإجراء مسح الأراضي العام، فحددت الإدارة المركزية من خلال التعليمتين2421 و4628 المؤرختين على التوالي 03ماي 2003 و4 سبتمبر 2004 إجراء سمح بتسوية عدد معتبر من هذه العقارات، إلا أن هذا الإجراء لم يحقق الأهداف المرجوة بسبب التزايد المتضاعف بمرور السنين لعدد مجموعات الملكية المسجلة في حساب المجهول مما أدى إلى وضع إجراء يرمي إلى تسجيل العقارات التابعة للخواص في حساب يسمى:« العقارات غير المطالب بها» وتتم التسوية القانونية للعقارات المسجلة في هذا الحساب حسب الكيفيات المحددة بموجب المادة 89 من قانون المالية 2018. The land survey encountered difficulties and obstacles mainly related to the absence of rights holders during the investigation, as well as the difficulty of determining the actual owners or owners of some real estate subject to the general land survey, The Central Administration, through Instructions 2421 and 4628 dated May 03, 2003 and September 4, 2004 respectively, set a procedure that allowed a considerable number of these properties to be settled, however, this procedure did not achieve the desired goals due to the doubled increase over the years in the number of property groups registered in the anonymous account, which led to the establishment of a procedure aimed at registering properties belonging to private properties in an account called: «unclaimed real estate» and the legal settlement of the real estate registered in this account takes place according to the methods specified under Article 89 of the 2018 Finance Law.
