دور القاضي الإداري الاستعجالي في عملية تفويض المرفق العام المحلي

Abstract

تهدف هذه الدراسة إلى تحديد كيفيات تدخل القاضي الإداري الإستعجالي في عقود تفويض المرفق العام المحلي والفائدة منها عند خرق إجراءات المنافسة والإشهار قبل إبرامها باعتبارها من فئة العقود الإدارية حسب المرسوم التنفيذي 18-199 المتعلق بتفويض المرفق العام المحلي، وقانون الإجراءات الإدارية والمدنية 08-09 ، وأن هذا الأخير لا يتدخل إلا بشروط من بينها تحريك دعوى بموجب عارضة أمام المحكمة الإدارية ضمن الآجال المحددة لرفعها والتي أثير جدل كبير حولها ،وعن المناهج فقد استرشدنا بالمنهج الوصفي في وصف المواد القانونية المرتبطة بهذا الموضوع والمنهج التحليلي في تحليلها ، وأهم ما تم توصل إليه أن تدخله في تفويض المرفق العام المحلي يعتبر مهم جدا في تصحيح بداية التفويض التي تكون معيبة والتي تبنى عليها مختلف المراحل اللاحقة وخاصة مرحلة التنفيذ ،وأنها مهمة جدا في حماية المال العام ومكافحة الفساد الإداري والمالي. Abstract: This study aims to determine how the emergency administrative judge interferes in the local public service delegation and the purpose of this intervention in the case of violations of competition procedures and publicity before the conclusion of such contracts, they fall within the category of administrative contracts, in accordance with executive decree no; 18/199 on the delegation of the local public service and the code of administrative and civil procedures 08/09. The latter is known to intervene only under conditions such as the fact that a case must be brought before the administrative court and be brought within the time limits set, which give rise to great uncertainty. And about of used curricula, we have been guided by the descriptive method to the description of the legal articles relating to this subject and the analytical method to their analysis. Most importantly, its involvement in the delegation of the local public service is considered to be very important in correcting its flawed beginning, on which the various subsequent stages, particularly the implementation phase, and it’s very important in protecting public finances and fighting administrative and financial corruption
