سلطات الإدارة في إبرام وتنفيذ الصفقات العمومية في القانون الجزائري

Abstract

إن الصفقات العمومية هي إحدى الوسائل التي تستخدمها الإدارة لتلبية احتياجاتها في مجال الأشغال واللوازم والخدمات والدراسات، وتخضع هذه الطائفة من العقود إلى نظام قانوني خاص، يمنح للإدارة سلطات استثنائية في ابرامها وكذلك في تنفيذها، يهدف هذا البحث إلى تسليط الضوء على مختلف هذه السلطات الاستثنائية التي تتمتع بها الإدارة، والضمانات التي أوجدها المشرع لحماية الطرف المتعاقد معها من أي تعسف في استعمال هذه السلطات. ABSTRACT: The public contracts one of the means that the administration uses to satisfy its needs in terms of works, supplies, services and studies. This category of contracts is subject to a particular legal regime, which grants the administration exceptional powers for their conclusion as well as for their execution. This research aims to clarify these different powers and the guarantees provided by the legislator to protect the contractor from any abuse in the use of these powers
