Abstract

ملخص تناولت هذه الدراسة حالة أسر واعتقال أصحاب حصانات مسؤولي الدولة ورجالها من الوزراء والنواب في المجلس التشريعي الفلسطيني، واعتقالهم في السجون والمعتقلات الإسرائيلية والتي تعتبر حالة نادرة وفريدة من الحالات التي اخترق فيها الاحتلال الإسرائيلي المواثيق الدولية، وتعدياً فاضحاً للأعراف الدبلوماسية بحق رجال الدولة وأصحاب الحصانات الدبلوماسية في الواقع الفلسطيني، فبين الباحث موقف الفقه الإسلامي من ذلك وما جاء عنه، وما نصت عليه القوانين الدولية وأبرز الباحث خطورة هذه القضية التي يخرق فيها الاحتلال الإسرائيلي المواثيق الدولية والأعراف القانونية.
