الحكم بالبطلان على الأقوال التفسيرية عند الإمام ابن عاشور من خلال كتابه التحرير والتنوير

Abstract

رصد البحث توظيف الحكم بالبطلان على القوال التفسريية عند الإمام محمد الطاهر بن عاشور في تفسير التحرير والتنوير والذي تظهر فيه الشخصية الناقدة للمفسر، و استعنت بالمنهج الاستقرائي، لإبراز المجالات المختلفة التي اطلق فيها الحكم بالبطلان، و كذا التعرف على أهم الأدوات التفسريية التي استعان بها لإصداره حكم البطلان. و خلصنا في نهاية هذا البحث إلى مجموعة من النتائج، أهمها: أن ما خالف أصول التفسير من غير مبرر حكم ابن عاشور عليه بالبطلان، وأن أكبر المجالات التي كثر فيها استعمال لفظ البطلان هو مجال الأحكام الشرعية. The research monitored the use of the ruling of invalidity by Imam Muhammad al-Tahir bin Ashour in the interpretation of Tahrir and Enlightenment, in which the critical personality of the interpreter appears, and I used the inductive approach, to highlight the various areas in which the ruling of invalidity was issued, as well as identifying the most important interpretive tools that he used to issue the ruling of invalidity. At the end of this research, we concluded a set of results, the most important of which is: Everything that completely contradicts the principles of interpretation is ruled invalid, and the largest area in which the word invalidity has spread widely is used in the field of legal rulings.
