أسس ومرتكزات التجديد في الفقه الإسلامي

Abstract

ملخص المداخلة تتناول هذه المداخلة الحديث عن أسس ومرتكزات التجديد في الفقه الإسلامي؛ وتكمن أهمية هذا البحث في كونه يعد مساهمة في إبراز أصالة التجديد الفقهي, وانتفاء مظاهر الجمود والركود عن الفقه الإسلامي . وأما عن الإشكالية فتتمثل في البحث عن وجود ما يثبت أن التجديد الفقهي المعاصر لا يعد بدعا من القول وليس تشويها لأصالة هذا الفقه، ولخصائصه الأصيلة التي اتضحت معالمها منذ نشأة هذا الفقه وتطوره عبر العصور . ولمعالجة هذه الإشكالية، فقد اعتمدت على المنهج الاستقرائي والتحليلي في الكشف عن أسس ومرتكزات التجديد الفقهي والمتمثلة في : 1 - احتفاء الإسلام كدين بالتجديد . 2- صلاحية الشريعة الإسلامية للتطبيق في كل زمان ومكان 3- عالمية الشريعة الإسلامية وعلاقتها بالتجديد الفقهي 4 - الاجتهاد وعلاقته بالتجديد الفقهي 5 – أسلمة القوانين .

This intervention discusses the foundations and pillars of renewal in Islamic jurisprudence . The importance of this research lies in the fact that it is considered a contribution to highlighting the originality of jurisprudential renewal and the absence of signs of stagnation and stagnation jurisprudence As for the problem, it is represented in searching for the existence of evidence that proves that contemporary jurisprudential innovation is not considered an innovation and is not a distrotion of the originality of this jurisprudence and its inherent characteristics, the features of which have become clear since the inception of this jurisprudence and its development throughout the ages . To address this problem, Ihave relied on the inductive and analytical approach in revealing the foundations of and the foundations of jurisprudential renewal, which are : 1 – lslam as a religion celebrates renewal 2- The validity of Islamic law to apply at all times and places 3- the universality of Islamic law and its relationship to jurisprudential renewal 4- ljtihad and its relationship to jurisprudential renewal 5- Islamization of laws
